These terms cover x1agent.com (the marketing site) and the x1agent platform when accessed under a commercial license from us. By using either, you agree to what's below. If you don't, don't use them.
Who you're agreeing with
x1agent is operated by DEV360 LLC, a Georgia limited liability company ("x1agent", "we", "us"). Contact: christian@x1agent.com.
Using the website
x1agent.com is a marketing site. You can read it, bookmark it, link to it. Don't scrape it at high volume, don't try to break it, don't impersonate us. Submitting the access form means the information you provide is accurate and you have authority to provide it.
Using the platform
The x1agent platform is licensed software you run on your own infrastructure. Your license — terms, scope, fees, support — is whatever's in the order form or commercial agreement we sign. These terms apply alongside that agreement; if anything conflicts, the order form wins.
Without a license you may not use the x1agent platform in production, redistribute it, or build a competing service from it.
What you're responsible for
When you run x1agent in your own cluster:
- Operating the cluster and securing access to it
- The behavior of agents you configure, including the cost of LLM API calls they make
- Compliance with the terms of any third-party services you connect (OpenAI, Anthropic, Slack, GitHub, Google, etc.)
- The lawful use of any data agents read or write on your behalf
Don't use x1agent to violate the law, infringe rights, send spam, run attacks, or build a service whose primary purpose is to damage someone else's. We can terminate access for material misuse.
Our IP
x1agent owns the platform code, the documentation, the trademarks, and the design of x1agent.com. Your license grants you use of the platform — it doesn't transfer ownership of any of that.
Your IP
You own everything you put into x1agent — code, prompts, data, agent configurations. We claim no rights to it.
If you submit feedback, bug reports, or feature suggestions, we may use them to improve x1agent without obligation to you.
Third-party services
x1agent connects to third-party services you choose — language models, code hosts, messaging platforms. Those services have their own terms and outages. x1agent isn't responsible for what they do or for fees they charge you.
No warranty
x1agent is provided "as is" and "as available". We make no warranties — express, implied, statutory — that the platform will be error-free, uninterrupted, secure, or fit for any particular purpose. LLM-driven agents are non-deterministic; review their outputs before acting on anything important.
Some jurisdictions don't allow disclaimer of implied warranties; in those, our warranties are limited to the minimum the law allows.
Limitation of liability
To the maximum extent permitted by law, x1agent is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data — even if we knew the damages were possible.
Our total liability for any claim arising from these terms is capped at the greater of $100 USD or the fees you paid us in the twelve months before the claim arose.
Indemnity
You agree to defend and hold us harmless from claims arising from your use of x1agent in violation of these terms, your license, or any law.
Termination
You can stop using x1agent.com or the platform any time. We can suspend or terminate access for material breach of these terms, your license, or applicable law. Sections that by nature should survive termination (IP, no warranty, liability cap, indemnity, governing law) survive.
Governing law
These terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in Fulton County, Georgia, and you consent to that venue.
Changes to these terms
If we change these terms, we update the date at the top. Material changes get an email to anyone on the waitlist. Continued use after a change means you accept the new version.
